1. Receiving Entity
Information provided to Palacium by Users within the use of the Website will be held by Pax polis Ltd. whose address at P.O.B 32411 Area Code 6132301 Tel Aviv Israel. Any inquiries regarding the implementation of this Policy may be forwarded to: firstname.lastname@example.org.
2. Provision of Information
Within their use of the Website, Users may be asked by the Company to provide personal information in one of the following events:
a. To the extent a User wishes to join the Palacium Membership Club or become a Palacium Partner, with respect to which such User will be asked to provide personal information such as his personal name, address and workplace.
b. To the extent a User wishes to acquire the services of the Palacium Pack, with respect to which such User will be asked to provide detailed information regarding the property he owns which he intends to develop such as legal documents, sketches, plans, etc.
3. Membership and Partnership
Personal information which has been provided to Palacium by Users in order to join the Palacium Membership Club or become a Palacium Partner shall be managed as follows:
a. The information will be kept in confidence by the Company so long as such User has not terminated his membership in the Membership Club or as a Palacium Partner. The information shall not be used for direct marketing and shall not be transferred or sold to any third party excluding an entity which is in control, controlled by, or under common control with Palacium (an “Affiliate”).
b. To the extent a User requests to terminate his Membership in the Palacium Membership Club or cease to be a Palacium Partner, he shall provide to the Company in writing to the email address stated above a statement addressing such desire, and within 30 business days thereafter any and all information provided to the Company by such User following the lapse of such period shall be deleted and removed from the Company’s records; provided, however, that the Company shall be entitled to keep such information within a designated file only for its use if and to the extent a judicial proceeding is initiated by such User against the Company or in accordance to any applicable law.
c. By joining the Membership Club or becoming a Partner, User approves to receive notification, newsletters, emails and the like from Palacium via electronic means or any otherwise. User shall not be entitled to opt out from such approval, and a notice provided by him to the Company regarding his demand from the Company to cease the sending of any of the aforementioned material shall be deemed as a request to terminate his membership in the Membership Club or as a Palacium Partner.
4. Pre-examination Within a Palacium Pack
If a User expresses his desire to acquire the services of a Palacium Pack (the scope of which is detailed in the Website), he shall be asked to provide to the Company information regarding the Property he wishes to develop. Such information shall include, inter alia, legal documents, sketches, plans, imaging, illustrations and other personal information. The information provided shall be managed as follows:
a. The User will be asked to upload the information as an electronic file by using the Site’s platform.
b. By providing such information to the Company, User agrees that it shall be reviewed by an employee of Palacium or any service provider which Palacium has resolved to engage with, solely for the purpose of evaluating the feasibility to apply the services of the specified Palacium Pack to said Property.
c. User’s actual engagement with the Company for the provision of the Palacium Pack services including the rights and obligation of the parties with respect to the information provided shall be solely governed by a legally-binding agreement to be executed between the Company and the User.
d. Until a legally-binding agreement is executed, User may give notice to the Company in writing that he no longer intends to acquire any of the Palacium Packs and that all files uploaded by him are to be deleted. In such event, the Company shall delete any of the aforementioned files; provided, however, that the Company shall be entitled to keep such files within a designated file only for its use if and to the extent a judicial proceeding is initiated by such User against the Company or in accordance to any applicable law.
5. Disclosure Outside the Scope of the Website
The provision of any other information provided to Palacium by the User which is outside the scope of such User’s use of the Website including with respect to the engagement of the User with Palacium in a separate legally-binding agreement shall be governed solely by such agreement.
7. Processing Outside User’s Country of Residence
Palacium may transfer the information provided within the use of the Website outside User’s country of residence to its employees, affiliates or any of its service provider.
8. Change of Control
“Change of Control” means (a) any acquisition of at least 50% of Palacium’s issued and outstanding shares; (b) a merger into another company; and (c) sale of all or substantially all of Palacium’s assets.
9. Disclosure Upon a Competent Order
Palacium may be required to disclose personal information provided by Users to it by virtue of a subpoena, the initiating of a legal proceeding or under applicable law. Palacium shall abide to such demand insofar that it is made lawfully and is shall not be obligated to inform such User whose information it is required to disclose of such disclosure.
Palaicum disclaims any warranty or liability to information downloaded from the Company’s databases and reproduced to any third party way of hacking or by the use of any malicious software including Trojan horses, viruses, spyware and the like.
Palacium may communicate with its Users via any electronic means including email, text messaging and facsimile. To the extent necessary, notices by Palacium will be sent to one or more of the contact details provided by the User to the Company, and such notice will be deemed received by the User on the next business day following which the said notice was delivered. User represents that such contact details provided are correct and valid and that he shall inform the Company immediately of any change in such contact details. User waives any claim he may have in connection with the validity and truthful of the personal information he provided to the Company.
